Legislative Decree No. 249 of 31 December 2012, in the transposition of the EU Council Directive 2009/119/EC Of 14 September 2009 - imposing an obligation on Member States to maintain a minimum level of stock of crude oil and/or petroleum products - aims to strengthen national legislation on security oil stocks and to promote the level of competition in the oil sector, widening supply and provision opportunities for logistics and petroleum products.

As part of the pro-competitive initiatives promoted by Legislative Decree 249/2012, GME has been tasked with developing the following two market platforms:

  • Mineral Oils Logistics Platform, aimed at favoring the trading of short, medium and long-term logistics capabilities (P-LOGISTICS), whose founding principles have been defined by the Ministry of Economic Development, pursuant to Art. 21, para. 1, of Legislative Decree 249/2012, with Directorial Decree n.16618 of August 9, 2013.

  • Wholesale oil products platform, aimed at favoring the trading of liquid petroleum products for the transport sector whose constitution principles have been defined by the Ministry of Economic Development, pursuant to Art. 22, para. 1, of Decree 249/2012, with Directorial Decree n.16617 of August 9, 2013.

As for the oil logistics, Legislative Decree. 249/2012 provides that:

  • (Article 21, paragraph 2 of Legislative Decree 249/2012) the parties holding, for any purpose, mineral-oils storage capacity in Italy (even if not utilised), in deposits with a capacity greater than 3000 cubic meters, are required to annually report their available capacity to GME by using the data reporting template approved by Decree of the Ministry of Economic Development (Directorial Decree 17371/2013).

  • (Article 21, paragraph 3 of Legislative Decree 249/2012) the decree of the Ministry of Development to approve the Rules of P-LOGISTICS also provides for the operating modalities with which holders of mineral-oils storage facilities and mineral-oils processing facilities shall provide GME with data on the monthly capacity.

In implementing the provisions of Article 21, paragraph 3 of Legislative Decree 249/2012, the Ministry of Economic Development, with ministerial decree 5 July 2017, no. 17433 - approving the operating rules of the P-LOGISTICS - has defined the procedures by which the parties subject to the notification obligation referred to in article 2, paragraph 1, of the same decree, shall notify the monthly capacity for storage and transit of mineral-oils. By subsequent Ministerial Notice no. 1612 of 19 January 2018, pursuant to Article 2, paragraph 2.2 of the aforementioned decree, the necessary indications have been defined for the compilation, by obligated parties, of the templates for the collection of data on the monthly capacity for storage and transit of mineral-oils in the transitional trial period of the P-Logistics.
