Changing the Standard Agreement Model of the Data Reporting Platform (PDR)
For the benefit of prior disclosure and transparency of changes that GME intends to apply to the PDR contract, it is hereby disclosed that changes have been arranged to the PDR Standard Contract Model in order to manage more activities, made available by GME, in relation to the management of information flows with ACER, aimed at facilitating the participants of the PDR that use the "External data upload service" option. The changes will become effective as of April 7, 2016.

In particular, it has been provided for in Articles 1 and 3 of the PDR Agreement that, should notifications sent by ACER on the data sent it by GME contain error messages, GME agrees to carry out the following activities within the limits specified in the contract and according to the procedures and time limits specified in the PDR User Manual;

  • Automatic resending to ACER of the file prepared by the participant with respect to which ACER has reported in said notification message the presence of an issue of a purely technical- computer nature. It is understood that, if the problem reported by ACER in the error message is due to deviation of the format/contents of the file uploaded by the participant compared to the standards set by ACER, the participant should proceed to its correction and the subsequent uploading of the correct file onto the PDR, downstream of which GME will carry out the re-transmission of the report to ACER;

  • Opening, on behalf of the participant concerned and on request of the participant itself, of a ticket at ACER assistance center if the actions referred to in the previous paragraph did not correct the problem. In the latter case, the request for opening the ticket must be sent by the participant in the manner specified in the PDR Operations Manual.

It should also be noted that, for purely operational reasons relating to its internal database, GME has also considered useful to integrate the set of data required in relation to the natural person, designated by the participant of the PDR, chosen to access the platform (User).

As a result of the provisions of Article 9 of the PDR contract, it is understood that if the PDR participant does not intend to accept the changes outlined above, it will have the right to withdraw from the PDR contract by sending a notification to GME in the manner specified in the contract, within 15 days following the effective date of the publication of the contractual changes on the GME's website (which will take place on April 7, 2016) and will be announced via a dedicated notice.
