Updating the Standard Agreement Form of the Data Reporting Platform (PDR) – Terms and conditions related to the mandatory re-signing to use the data reporting services provided by GME

For the benefit of prior disclosure and transparency of the amendments that GME intends to make to the PDR Agreement, please note that, in order to upgrade its performance in terms of data reporting under the EU Regulation no. 1227/2011 (REMIT), GME has amended and supplemented the PDR Agreement also in order to make available new services and regulate the terms and conditions for their supply.
Therefore, the terms and conditions of the PDR Agreement have been amended also taking into due account any impact that new business projects being implemented may have in relation to the services provided by GME under the PDR Agreement.
The amendments made to the PDR Agreement are available, in review mode, at the following link Standard Agreement PDR Form and will become effective as from the date of completion of the PDR Agreement as set forth in Art. 7.1 of the same.
Please note that all the current PDR Participants shall sign and send GME the new version of the PDR Agreement - in original, initialed on each page and duly signed by the subject provided with the powers - by 21 September 2016, date beyond which GME will withdraw, with a notice of further thirty (30) calendar days, from all contractual relationships regarding the data reporting that may be still outstanding at that date and governed by the earlier version of the PDR Agreement.
In any case, the Participants can exercise the right of withdrawal from the PDR Agreement in the manner specified in the  Agreement itself.
It is understood that, while signing and executing the new version of the PDR Agreement, or, in case of withdrawal, until the date of its effectiveness, GME will ensure continuity in the data reporting service as currently selected by each PDR Participant who has not yet signed the new version of the PDR Agreement.
The Participant can sign the new version of the PDR Agreement from 18 July 2016, according to one of the modes shown below:

  • The PDR Participants which do not intend to change – at the time of signing the new PDR Agreement – the data provided (including the indication of the user) and the services required can download the contractual text already automatically completed with all the information in the platform directly from the PDR platform, by the “Re-signing the agreement” feature. In particular,
  • The document downloaded will automatically show the data/information related to the details of each Participant, the selection of the services already enabled, which cannot be changed by the Participant;
  • As for the “External data upload service” option, whose text has been modified in order to allow the upload of data of the contractual partners, the box shall be selected, also adding the relative initials confirming the service request, by all those Participants which wish to use the service (even if they do not intend to upload data of their contractual counterparties). Therefore, even those which have already requested the service previously, should they intend to continue to use it, will be required to again carry out the selection and put their initials.
  • The PDR Participants intending to change the data and information provided to GME, or the selection of the services required when signing the new PDR Agreement version, will access the public page of the corporate website of GME, namely the web form and enter all the data required, including the selection of the services required, and enter their initials next to each selected service, even if previously enabled. The new version of the PDR Agreement, initialed on each page and duly signed by the subject provided with the relevant powers, must be submitted in original to GME.

 

It is understood that, in relation to the services provided by GME within the PDR, the above update will not result in any change/integration for the Participant of the fee already paid for the current year.
